Rule 1.7 conflict

A concurrent conflict of interest under ABA Model Rule 1.7 between two current clients.

Rule 1.7 of the ABA Model Rules of Professional Conduct prohibits a lawyer from representing a client if the representation involves a "concurrent conflict of interest." A concurrent conflict exists when the representation of one client will be directly adverse to another, or there is a significant risk that representation of one will be materially limited by the lawyer's responsibilities to another.

A lawyer may represent a client despite a concurrent conflict if the lawyer reasonably believes the representation will not be adversely affected, the representation is not prohibited by law, the conflict does not involve clients on opposite sides of the same litigation, and each affected client gives informed consent in writing.
