AI use disclosure
Disclosure to clients that AI tools are used in their representation.
Under ABA Formal Opinion 512 and several state-bar opinions, lawyers should disclose the use of generative AI to clients when disclosure is reasonably necessary to inform the client. The disclosure is typically made in the engagement letter and references AI's use for drafting, research, and analysis, with the lawyer retaining final responsibility for the work product.
